A little over a year ago, legislation was introduced to expand the universe of Master Limited Partnerships (MLP) to include a number of renewable energy technologies. The Master Limited Partnerships Parity Act (MLPPA) was sponsored in the Senate by Sen. Chris Coons (D-DE) and in the House by US Rep. Ted Poe (R-TX).

The�summary�of the MLPPA (S.795,�H.R.1696) reads:

Master Limited Partnerships Parity Act�- Amends the Internal Revenue Code, with respect to the tax treatment of publicly traded partnerships as corporations, to expand the definition of “qualifying income” for such partnerships to include income and gains from renewable and alternative fuels (in addition to fossil fuels), including energy derived from thermal resources, waste, renewable fuels and chemicals, energy efficient buildings, gasification, and carbon capture in secure geological storage.

The bill seeks the same tax treatment for renewable energy partnerships as that given to fossil fuel partnerships. MLPs are designed to lower the cost of capital for companies, but when Congress legislated the rules for publicly traded partnerships in 1987 it required that at least 90 percent of an MLP�� income must come from qualified sources, such as real estate or natural resources. Section 613 of the tax code requires qualifying energy sources to be depletable resources or their derivatives such as crude oil, petroleum products, natural gas and coal.

    I ran a subjective screen of the companies in IYT, using the following criteria:

    First, I eliminated the airline stocks. I would never own an airline stock individually: they have a long tradition of providing poor returns for their shareholders. A glimpse at a few ten year charts for component airlines like Delta (DAL), Jetblue (JBLU), Southwest (LUV) and United Continental Holdings (UAL) shows a lot of volatility and pitiful gains. The exact opposite of what investors should be looking for. Furthermore they are oil price sensitive: a more efficient way to trade this is an oil ETF. And yes, they are becoming more efficient with newer engines, but Boeing (BA) is a more efficient way to trade that issue. Second, I looked for companies that have shown (nearly) uninterrupted earnings growth since the recession ended in 2009. Sure maybe a soft quarter here and there; but solid growth. If the issue was a bit in doubt I turned to the company's ten year record, and insisted if growth was negative during the recession, it recover swiftly afterward and share net go on to new highs. finally, I wanted the company's trailing PE ratio to be near the bottom of its ten year range.

    Yes, these screen criteria are more subjective than a pure computer screen would be, but this leaves room for investor analysis and judgment, which never should be off the table when making an investment.

    Lynne Sladky/AP WASHINGTON -- U.S. airlines scored their second best performance last year in the more than two decades that researchers have been measuring airline quality, with Virgin America the leader, says an annual report released Monday. The report ranked the 14 largest U.S. airlines based on on-time arrivals, mishandled bags, consumer complaints and passengers who were bought tickets but were turned away because flights were over booked. Airline performance in 2012 was the second highest in the 23 years that Wichita State University at Omaha in Nebraska and Purdue University in Indiana have tracked the performance of airlines. The airline's best year was 2011. Virgin America, headquartered in Burlingame, Calif., did the best job on baggage handling and had the second-lowest rate of passengers denied seats due to overbookings. United Airlines (UAL), whose consumer complaint rate nearly doubled last year, had the worst performance. United has merged with Continental Airlines, but has had rough spots in integrating the operations of the two carriers. The number of complaints consumers filed with the Department of Transportation overall surged by one-fifth last year to 11,445 complaints, up from 9,414 in 2011. "Over the 20 some year history we've looked at it, this is still the best time of airline performance we've ever seen," said Dean Headley, a business professor at Wichita State University in Kansas, who has co-written the annual report. The best year was 2011, which was only slightly better than last year, he said. Despite those improvements, it isn't surprising that passengers are getting grumpier, Headley said. Carriers keep shrinking the size of seats in order to stuff more people into planes. Empty middle seats that might provide a little more room have vanished.     Volcano (NASDAQ: VOLC) shares tumbled 19.58 percent to $12.69 on Q2 results. The company reported Q2 earnings of $0.01 per share on revenue of $102.60 million. Volcano announced its plans to divest its Axsun Technologies subsidiary and also announced the litigation settlement agreement with St. Jude Medical (NYSE: STJ). Oppenheimer downgraded Volcano from Outperform to Market Perform and lowered the price target from $22.00 to $15.00.

    Shares of Volcano (VOLC) were up 8% in afternoon trading, following the company�� better-than-expected second-quarter earnings report and a spate of positive analyst commentary.

    The medical device company said it earned 3 cents a share, whereas analysts were expecting a one cent per share loss. Revenues of $101.3 million also topped consensus estimates of $97.9 million.

    Volcano also issued mixed guidance for the full year, saying it expects to earn between 3 and 5 cents a share on revenue of $394 million to $400 million. Analysts are modeling for earnings per share of a nickel on $395.8 million in sales.

    Analysts were also largely positive about the quarter. Canaccord Genuity�� Jason Mills and Jeffery Chu upgraded the stock from Hold to Buy and boosted their price target by $5 to $26 on the news. ��olid or improving revenue growth trends and margin expansion are tried and true drivers of small-cap med-tech multiples.
